Talked to Glenn again last night and Rocky (his wife) called me this morning. They're seriously in danger of losing everything, including their house and the new business that was set to open in a couple of weeks. Glenn's asking that friends of the Leafe take up a sort of PR campaign on the band's website-- not to mention the Leafe, per se, but to bitch about why the band keeps canceling shows. If you have time, I know Glenn would appreciate any support. Save the Green Leafe!
really? I def would NOT have thought this would be that threatening.... food poinsoning isn't that uncommon, and so long as they are up to codes and it wasn't intentional, what legal action could be taken? Is the band actually trying to recooperate money lost from cancelling shows?
I would think the fault/negligence whatever would fall on the supplier, if they can even prove that they were ill b/c of what they ate at the leafe, which is probably harder than it sounds. also, the band would have to make efforts to mitigate any damages, which would include rescheduleing shows... and i bet mcr doesn't really get that much compensation from shows after costs, fees, etc.
Band is trying to recoup $$$ from canceled shows (and I think they're STILL NOT PLAYING), and there are Board of Health issues to boot. Who knew food poisoning could be this ridiculous?
There were two other catering gigs that same day, and all three got sick. Only common thread was the produce, so it doesn't appear that the Leafe is negligent there, but there's still a whole bunch of other messy shit that I don't quite understand. Glenn's touching base with his lawyers and insurance reps--
will have a hard time proving damages, especially with mitigation issues (like, if mcr players were find, certainly can't justify cancelling b/c opening act's crew wasn't there, or even opening act, etc. and they can re-schedule shows....). also, he can probably turn around and stick it to the produce dealer, if there is proof it came from the leafe and then that's the common thread. the brd of health issues is a whole nother story. i never knew food poisoning, that isn't the result of horrible gross way below code standards (which we all know the leafe is not), could be this bad. i hope insurance is good.
I found if they were not written by the Flat Hat or the daily press never mentioned the Green Leafe. There was one personal injury law firm site that had a link to it to try and get a class action suit going. Vultures!
